Can someone explain how unsafe operation (39:4-97.2) works?

I was told it meant you could use it twice with no points, then had to wait five years before you could get no points again. But a municipal prosecutor explained it differently. Someone please help!

39:4-97.2 unsafe driving was enacted to allow people with 2 point tickets to reduce to 0 points without an attorney. It became so popular that the Legislature attached a $250 surcharge on top of the $50-$150 first time fine and the $150-$250 second time fine, all plus court costs. You can use the Statute twice in 5 years. Then you cannot use it again for 5 years after the second offense. You count from the date of the offense not the conviction. If you use it before the 5 years is up it is 4 points. The third time most courts consider you a second so the fine is higher. Also if you are a provisional driver you cannot use unsafe driving or any other 0 point ticket.
