Ex refuses to sign Texas final divorce decree. How long can she delay the divorce? Can it be finalized without her signature?

After two years of trying to get divorced, with my ex fighting every move, we finally came to an agreement and signed a Rule 11. As soon as we signed it, we went before the judge and I answered lots of questions. My attorney then asked my ex if she had heard all the questions and if she agreed with my answers. The judge then said he would grant the divorce and gave us an entry date. Later, when I got a copy of the Final Decree, I signed it and gave it back to my attorney. The entry date came and went. I found out that my ex refused to sign it. She wants changes made on things SHE asked for in mediation. We refuse to make changes. I’m hoping we can complete this without her if possible. The decree has spaces for my signature, my ex's signature, both attorneys, and the judge.

You may be able to complete it without her, but I'd need more information to give a definite answer. Since you have an attorney, you should really discuss this issue with him/her.

I do not know enough about your case to give you a definitive answer, but I will give you a general answer. In a situation where one party has agreed to terms and all that remains is a signature on a formal final order and one party refuses to sign, you can file a motion to sign the final decree. In some instances, you can ask for attorney fees that were necesarry to file the motion and appear at the hearing. Another option is sending a copy to the opposing attorney with a 10 day notice letter stating that the decree will be submitted to the judge for his signature if there is no objection. However, it sounds like they are making objections. You really need to discuss your options with your attorney.

The answers given are good. Most important, consult with your attorney. Pay him or her if you still owe money. If all the issues have been resolved in the Rule 11 Agreement, then your attorney should file a motion to enter final decree.
