Why is the adjuster taking so long to respond to demand?

Business 2 views 4 answers
The demand was sent over six months ago. The adjuster asked for ALL of my medical records and that took 3 months. Then he wanted updated records, another 2 months. Now he has asked for another extention. Can anyone give me some information as to why he has not responded with any offer and why he keeps asking for more time? I do have some serious injuries but I dont know why so many delays.

Are you trying to do this on your own? If so, they may be blowing you off to see if your statute of limitations (time to sue) expires and you cannot file your claim. On the other hand, if you have a lawyer that is handling this mattr for you, you definitely need to sit down with him/her to determine what your next steps and/or options are and to determine why the adjustor is taking so long. If you have no lawyer I highly suggest you collect all the evidence and items you have and that you also have sent the adjustor and go see a lawyer of your choice right away. Alejandro R. Lopez, Esq. There are several likely reasons that may be contributing to this delay. From the limited facts supplied, I am uncertain if you are represented by legal counsel. If you are unrepresented the Claims Adjuster likely perceives that there is little to worry about. Most consumers lack the knowledge to file a lawsuit without the assistance of an attorney. Further, the adjuster is possibly operating under the assumption that he or she can continue to stall with ongoing dilatory tactics as the only recourse you have available is to file a lawsuit. If you are presently represented by an attorney, it is time for you to schedule an in-person meeting to gain a better understanding as to the reasons behind any delay and the next step(s) in the case. I wish you the best luck.

There are a number of reasons that an adjuster can take long to respond to a demand letter. It all depends on the facts and circumstances of your case, as well as the extent of your injuries. I would recommend raising your concerns to your own attorney. I normally avoid pre-suit demands because it usually ends up being a waste of time, but again it absolutely depends on the facts of your case. Each case is different. Talk to your attorney.

I do not understand why piecemeal specials have been provided to the adjuster. Often that is not helpful to your situation. Since you have serious injuries, I assume that you have an attorney. Your attorney should be able to answer your questions about the delays. If you do not have an attorney and are representing yourself, you are doing yourself a disservice. You should obtain needed medical care and treatment immediately and follow the doctor's advice. Do not give any statement to the adverse party or insurance company nor grant them access to any medical records. Photograph the injuries and the damage done to any property. Contact a personal injury attorney in your area as soon as possible so that you can protect your rights.
