I was charged of petit larceny in Virginia county of fairfax . I hired a attorney and he filed a not guilty plea and judge offered me a diversion program of community service. On my court records it appear as a deffered disposition. My court date for disposition is approaching . My employer just came to know about it and they suspended me till my last court date and said they will wait for the final outcome. Is it possible that my employer will treat this case as dismissed and allow me back ? Can this record be expunged for future since i am working hard at my college .

I cannot offer you any advice on your employment relationship, but with respect to expungment in Virginia, there are two critical facts to keep in mind in determining whether in this particular case you are eligible for expungement: (1) you cannot enter a plea of guilty or no contest; and (2) there cannot be any finding by the court that the evidence in your case was sufficient to establish guilt. If those two conditions are met, you should be eligible for expungement of your charge in Virginia once the charge is dismissed.
