Does my ex have the right to see his daughter?
Anonymous3 views3 answers
We just went to child support court and he has been put on it. He is now demanding to see her. He says that he has every right to come and take her to his home. I disagree with that. He has to many roommates and animals. Plus he has no visitation through the court. Can he take her with out my permission?
The child's father can petition for establishment of his parental rights, and the more you resist the more effort he may choose to make to do so. Your child has a right to grow up knowing both parents and a chance for a healthy and positive relationship with both. The most loving thing you can do for your child is facilitate that positive relationship with him. That's right-- facilitate. Maybe he has too many roommates and animals, but that does not justify denying his contact. You might choose to help make arrangements for his contact that will be healthy and safe for the child. If you can help make some contact arrangements work successfully, his ability to obtain court orders that you don't like at all will be reduced. Since this is not coming to you naturally, you may benefit from counseling to learn methods for joint parenting that serve your child's best interests.
Best wishes for an outcome you can accept, and please remember to designate a best answer.

He can file a petition with the court and the court will treat him exactly
as if he was a divorced father. He will have contact rights. They will be
set by the court if the two of you cannot agree. You should consult a
lawyer to advise you on the specifics of your case.

If you all were never married and only child support was established at the hearing (for example, if it were a Department of Revenue case), he does not have the absolute right to come and pick up the child. He will need to go to court himself and get a time-sharing plan in place.
