I am the mother of the children but the father has custody of the children. I want to get the custody of the children but I can't afford a lawyer. What are my chances of getting the children back if I represent myself?

You can go to Family Court to seek custody of your children without a lawyer, but I do not recommend it. If you cannot afford an attorney, you may qualify for Court-appointed counsel. Consult with the Family Court Clerk in your County regarding the petition to file for an award of custody (they cannot give you legal advice, however), and when you appear before the Judge, ask them if you qualify for Court-appointed counsel. They will ask you some questions about what income you have, whether you own a home, and how you support yourself. If you meet the specific criteria, they will appoint an attorney to represent you in Court. Good luck. LEGAL DISCLAIMER Mr. Rosen practices matrimonial and family law in Great, Neck, NY.
