A succession is the Louisiana probate process that transfers ownership from the deceased to his or her successors. So if either of the deceased owned probate property, you will need either a succession or a succession affidavit to transfer ownership of the property each owned to the living successors. The length of time it takes depends on the complexity of each situation. Also, to qualify for the small succession affidavit procedure an estate cannot exceed $75,000. Depending on the facts, a succession can be a set fee matter or it can be hourly. Mark R. Callender is licensed to practice law in the state of Louisiana only. You can do both successions in one proceeding. If all the heirs sign the pleadings it can be done in about a week. Otherwise it may take several months or longer depending upon what the other parties do. A simply succession normally would be handled as a flat fee, but if there are going to be hearings, or the matter involves multiple filings it normally would be done on an hourly basis.
