Motion to Set Aside Court Fees

2 views 2 answers
I recently had my license suspended by the clerks office for failure to pay outstanding court costs. I never received any notice regarding these fees, and I did not know I owed any. Do I simply file a Motion to Set Aside Court/Clerk fees as I never received notice. This is/was a criminal case.

You should have gotten notice in court of your fines. Pay them off and you should be able to avoid the suspension. You may also be able to do a payment plan.

Entering a plea to a criminal charge is really an acknowledgment of your responsibility to satisfy any and all conditions imposed by the Court. Because the burden is on you to complete those conditions, I don't think you will succeed on a motion to set aside the fees on notice grounds. Your best bet is to take care of those fees and clear up your Driver's License ASAP.
