Abandonment of Lawful Permanent Resident Status....
Hi there, me again, i just want to say thank you for all your answers. They have been really usefull.
Now i have a new question and I thank you in advance for your answer.
I have a friend that became Permanent Resident long time ago.He worked for a long time while living in the US paying taxes, rent, eveything.
He also made the test to become US Citizen and passed. But he never showed up at the Oath ceremony nor called to re-arrange another appoinment to
go to the Oath ceremony. For some reason he moved in to Mexico and lived there for almost 10 years. I'm not sure but something like that.
While in Mexico he lost his Green card and never replaced it, so when he needed to come back,He went to the consulate there in Mexico, appareantly the US officer suggested that he should apply for a Tourist Visa and fill the form I 407 so he did. Now that he is 65 and disable he wants to retire and get the
disability benefits. He tried to replace his Green card, He sent the I 90 Form but it has been more then 10 months he went to the fingerprints and still waiting for an answer or his Green card in the mail.
Questions
1 Once he filed form I 407
Abandonment of Lawful Permanent Resident Status. Can he reapply for a green card and get all his benefits and all the retirement that he work for more then 30 years or he lost everything by singing that?
Because I know abandonment is irriversible.
2 When he did the test for US citizenship but never showed up at the Oath ceremony and he went away for almost 10 years, eventhoug he past the tests. Does it mean he is already a US citizen and he doesnt need to reapply for a Green card?
3 He went to the Social Security office to apply for his retirement and he was told that he needed to bring his green card so they can process his retirment.
Can he reicive some SS benefits or Medical assistance eventhoug he apparently is not a US Citizen nor Permanent Resident, and he actually has a Visa tourist.
He has 3 US Citizens kids over 21 or what can he do about it. if there is something he can do.
