Can I remove my criminal record from a county's online database of their public record?

I recently was involved in a situation where I was arrested by a police officer for a misdemeanor in Gwinnett County, GA. After going through Pre-Trial Diversion, my case was dismissed and my record was expunged. However, Gwinnett County keeps an online database of their public records (gwinnettcourts.com). From what I been told, my arrest and case will not show up in a background check except to government agencies, but will continue to show in public records and consequently their online version of public records. Have I understood that correctly? Ideally, I would like to get my name removed from the website because it’s easier for someone to go on that website and look for me instead of paying $70 for a GBI background check. These days, everyone can look you up online.

Contact the Gwinnett Co. Clerk of Court. They see this situation a lot and will be the place to start. As you pointed out, with online court databases being so prevalent, its no longer enough for your record to simply be expunged- these court records often remain and show the entire history of your case.

The problem is that while you can get the charges expunged or dropped, the reality of the arrest itself does not go away. Things like that are reported in the newspaper and online, where they live forever. You cannot threaten or request that the information be removed, because it is true. Therefore, I do not believe there is anything you can do, but it should not affect employers running a background check because it will not appear there.
