Laws are generally either created by statute (which provide for statutory remedies) or by judicial decision. Without any information about your lawsuit or its second cause of action, further analysis or explanation is not possible.

In a civil lawsuit, statutory remedies are those damage recoveries which are set forth by a code section or statute. For example, in construction law, statutory remedies include mechanic’s liens, stop notices, and surety bonds.

Statutory remedies are remedies specifically set forth in a statute. In contrast many other types of remedies may be those that have derived from judicial decisions (court opinions) even if not specifically set forth in a statute. As mentioned, there are two primary ways in which law is created - by statute and by judicial decisions.
