Child Custody and Warrant out for arrest

Bankruptcy and Debt 2 views 1 answers
A childs father has papers served to the mother for child custody. Afterwards the mother calls and says she is going to put out a warrant for his arrest simply because he wants custody. She said she will say he is communicating threats? He is upset that he may be put in jail for something said and made up. Is this legal? Can she do this?

No, she can't. No magistrate will issue a warrant on those facts. It is a civil matter to be determined by the district court in a child custody action, which the father has already started. I would recommend he speak with his attorney on this matter. Tony Hartsoe Hartsoe & Associates, P.C. www.hartsoelaw.com 888-725-1985
