A fee waiver application was filed with the form I-290B and it was rejected for not submitting the correct fee. 1- Is the form I-290B eligible for fee waiver? 2- How long is the applicant afforded to resubmit the I-290B form with the correct fee if the later is really required?

1. Conditional Fee Waivers: You may request a fee waiver for an I-290B only if the underlying application was fee exempt, the fee was waived, or it was eligible for a fee waiver. 2. If the fee waiver is denied, then you will still need to submit the fee in a timely manner, which could be too late, based on the delay in adjudication the waiver request. If you try it, you better have a very high likelihood of receiving the waiver.

The fee can be waived you must show however your inability to pay. In your case I would be more concerned about the time to file you motion to reconsider or appeal. If you do not file within the time frame as stated on the denial notice, you will lose your right to file your motion or appeal. An application without a fee is not considered filed properly. Yes, the form is eligible for a fee waiver. You have 30 days to submit the appeal from the denial of the underlying petition.
