Traffic violation law in Illinois.

I was issued a speeding ticket in Kankakee, IL (May 05, 2012 People State of Illinois vs) driving 85 mph on a 65 mph speed limit. There is no court appearance required but I was given the option of "Plea of Guilty"/Application for Supervision form. I was given a $120 individual bond plus $40 if I have to take the safety course. Prior to this, I was issued a traffic violation in Chicago, Il (Jan 20, 2012 City of Chicago, Municipal Corporation, Plaintiff vs) of which I attended and completed a 4 hours class on web Mar 25, 2012. Since I had attended a prior 4 hour safety course due to the Chicago municipal violation , am I eligible for the 4 hour safety course in Kankakee, IL ? If not, will that make it an 8 hour safety course instead like what they offer in Cook County ?

Obviously the first safety course was not enough for you to get the message. Take it again

Read the form closely. It will specifically tell you whether you are eligible for court supervision online. If you are still unsure, then do not plead guilty. Instead hire a local attorney and go to court where he/she can ask for supersion from the judge.

You are allowed supervision only twice in a one year period. It is likely the form specifies whether you are eligible or not. The nature of the charging document, municipal violation or violation of the Illinois vehicle code does not control. Sincerely, Attorney Mitchell S. Sexner Mitchell S.
