My ex wife dropped my 12 year old daughter off last week 4/29/12 and said that she could no longer handle her .

About 2 years ago my daughter was going to run away from her mothers house , after one of her friends called to let me know I picked her up from her mother's before she actually got to run away then contacted her mother that she was with me and that I would like her to move in permantly . After a couple of weeks had passed , her mother changed her mind and picked up my daughter threatning to call the police should I not cooperate , while reminding me that she still had legal custody . My ex wife dropped my 12 year old daughter off last week 4/29/12 and said that she could no longer handle her and that she needed her father . What steps do I need to take to get this legal , what rights do I have if she changes her mind again , and at what point do I look at stopping child support ? Thanks

I agree with the previous answer to the degree that the easiest way to resolve this would be to have a consent order drafted and submitted to the court for entry. If the mother is not willing to sign such an order, retain an attorney and file a motion for change of custody and modification of child support. Consult with an attorney immediately. Next time (and maybe it is not too late this time) tell her that you are not a yo-yo and she will have to sign an agreement transferring custody to you. Maybe even now, she will agree. Have an attorney draft something you can both sign that the Court will enter as an order.

I would file a motion to change custody and draft an order that would change custody to you.. Ask your ex to stipulate to the order... Child support should be recalculated as soon as you gain legal custoday (and your ex may owe you support because it is dependent in part on the number of overnights you have with her.. so)
