Wage levels for H-1B?

4 views 3 answers
Dear experts, My company in CA intends to hire a foreigner who has a bachelor degree and 5-year work experience. I told my attorney that the minimum requirements for the position are bachelor degree plus 5-year work experience. The attorney got back to me with the prevailing wage at level 4. However, what I can offer is at most at level 1. Is my attorney correct on this? If I reduce the minimum requirements to bachelor degree, can we get level 1 prevailing wage? Thanks a lot.

The Department of Labor will almost certainly not issue a level 1 or even 2 with the requirements you state. However, without details, it is not possible to state whether your attorney is correct or not.

The higher the requirements for the position (i.e., degree, experience) the higher the wage level. If you want a Level One wage, then you cannot ask for 5 years experience. You are looking for entry-level candidate.
