How do I find court papers for a counterclaim for eviction in the state of Washington? Landlord refuses to except my rent X2.

I received court papers for an eviction on the 11th of May. I have tried two different times to give him the rent prior to the receipt of papers. He has refused to take it both times. What can I do? I was given a web site address and can not find what I need. Please Help! Thank you. Danette Thompson. [email protected]

If a landlord issues a 3 day pay or vacate notice that is not complied with within the 3 days, the landlord has no duty to accept any rent after that. If you tendered (tried to pay him) within the 3 day period, you may have a defense to the eviction based on lack of subject matter jurisdiction. Finally, if you have an unexpired lease that is not currently a month to month agreement, you may reinstate the tenancy if you pay the full amount of the judgment (rent+attorney fees+court costs) within 5 court days of entry of the judgement. (Google search rcw 59.18.410 and read the entire statue).

Mr. Weatherstone's right. This turns on whether you have a lease that has not by its terms expired. If you do, then you can pay your money into the court registry and you don't need your landlord's agreement to do so. Get a receipt and be sure the money goes to the correct case number so you get credit for depositing the funds into the registry. Many courts will not take your check, so you can use money orders or cash to do this. Hope this helps. Elizabeth Powell
