Will my DUI (first offense) affect my job application in different state?

Business 2 views 3 answers
I had a DUI in January (in Illinois) this year and my last court date is this month. I have a job interview in Wisconsin the day after my court date. My lawyer told me that most likely I will get court supervision. Should I mention the DUI in my job application, and if i do, can they decide not to hire me for a DUI offense? Thanks

Do not volunteer any information. Most employers are limited to inquiring only about convictions, not arrests. If you do receive court supervision, that is not a conviction and you can honestly answer "no" if you are asked about ever having been convicted of a crime. There are other ways, however, that an employer might find the DUI arrest without you offering that info: If the job requires driving or use of company vehicles they will probably obtain your driving record. If, for example, you were suspended for refusing/failing a breath test, that information is public record until the suspension ends. Make sure you pay your reinstatement fee as soon as possible; otherwise that suspension will remain open and anyone checking your record will know that you were arrested for DUI.

Are they going to ask about it? Why mention anything if they don't ask? I wouldn't. Does the job in Wisconsin involve driving. Direct these questions to your lawyer. You're already paying them... they should be able to give you proper guidance.

Your paying an attorney who knows all the details about your case. That should be the person you ask. If the case is disposed of and you receive supervision, that is not considered a conviction.
