He can, unless you do something about it. You need to get to an attorney to file your own complaint for divorce so that the court has jurisdiction to enter orders dealing with such matters as the possession of the home, support, etc. Do not delay.

If you are on the deed to the house you have rights to be there and often the police will assist you in getting back in the home. However, it might not be somewhere you really want to be if your husband is being so unpleasant. If he is physically abusive toward you a restraining order may be necessary. I recommend that you see an attorney right away. If you are dependent upon your husband for your support you may be able to immediately get some post-separation support awarded to you by a Judge. As far as the property, the Court's job is to distribute it "equitably", which in most cases is 50/50. If you are served with divorce papers you need to take action immediately. Once a divorce is finalized you lose your right to seek property and support unless you already have claims pending.

I agree with my colleagues - you need to see an attorney about the following issues: 1) separation, including post-separation support and alimony, 2) equitable distribution, 3) domestic violence. If there is violence involved, you may be able to take out a restraining order against him, and maintain the marital residence as yours.

I need more information to give you accurate advice. Is there a premarital agreement? Is your husband employed? Are there grounds for having you removed? We can discuss this if you will schedule a free 15 minute consultation with me.
