Can i sue the school system for negligence?

my 6 yr old daughter's kindergarden teacher left her alone in the classroom for an extended amount of time in which and older male student entered the classroom and sexually assaulted her. i have filed criminal charges aginst the boy. can i sue the school system for negligence? the teacher has admitted the she left my daughter alone because the school has already so-called reprimanded her. that in itself is an admission of guilt. there is enough evidence that the detective said they would in fact file charges against the boy. the principal said she spoke with the boy's stepfather (the boy denied all charges) and told the step father that she 100% believed that what my daughter was claiming was true.

On these facts alone without more, you and your daughter may indeed have a claim against the school board as well as the kindergarten teacher for money damages. Since this is likely a public school system, there are likely strict notice of suit requirements that must be met before you can file any kind of lawsuit. Talk to an experienced personal injury attorney immediately. Failure to comply with these types of notice provisions can be fatal for your claim. Factually, you've got a failure to supervise (curious how long teacher left kids unattended) which is strong evidence of negligence. You'll want to know whether teacher behaved this way often; whether other similar events occurred; whether the administration knew of teachers behavior, etc. You also have a direct claim for money damages against the juvenile and his parents. The parents homeowners policy could be an additional potential source of recovery or the parents could have personal means to satisfy a future judgment. I'm sorry to hear that this occurred.
