Anonymous2 views2 answers
STARTED WITH ME FALL A MONTH BEHIND IN MY RENT.MY LANDLORD POSTED A 3 DAY NOTICE ON MY DOOR.THEN CAME OVER TO SAY HE WANTED TO HELP. THEN ASKED IF I WOULD SELL HIM MY MOTORCYCLE WORTH 10,000 AND IT WOULD TAKE CARE OF THE RENT FOR THE REST OF MY LEASE AND THE MONTH BEHIND AND LATE FEES.SO I FINALLY AGREED..WE PUT IT ALL IN WRITING AND SIGNED.TWO DAYS LATER I RECIEVED A 5 DAY NOTICE ON MY DOOR..HE STARTED AN EVICTION PROCESS STATING I HAD A FISH TANK IN MY HOUSE AND THAT HIS LEASE SAID NO PETS..HE SAID MY GARAGE HAD OIL STAINS FROM WORKING ON CARS. AND MY A/C UNIT FILTER WHERE NOT CHANGED MONTHLY.ALL OF THIS WAS BOGUS AND NOT CORRECT..SO I HIRED AND ATTORNEY BUT HE DIDNT FILE THE ANSWER IN TIME AND THE JUDGE EVICTED ME..NOW I HAVE A EVICTION ON MY FILE AND LOST MY BIKE/MONEY.WHAT CAN I DO
I would sue your former attorney. It sounds like he committed malpractice. I don't think you have much recourse against your former landlord. Confirm with a Florida attorney.
You should see a local attorney to discuss your case.
You still need to have a lawyer follow up on the case to protect
you against the money damages part of the lawsuit (if a 20 day summons was
served or a hybrid 5 and 20 day summons was served, then
there is a count two for money damages).
If you don't want to let the first attorney handle it, then you should
get another one.
Please make sure this first attorney files something appropriate or get
a new one. You can use the link above "Find a Lawyer" or call the
Florida Bar Association for the referral service.
Good luck!
