U visa while on OPT I am the victim of the crime and the crime occurred way back in 2003 while i was working in the gas station. I meet all the requirements for applying U visa. But, I am on OPT as of right now and my OPT will expire this December. I was on the F1 status while the incident occurred and is still on the F1 status. Does it matter me being on the F1 status while the incident occurred and what happens to my status once i apply. what is the worst case scenario if my case gets denied?

To qualify for a U visa you must be assisting the government - police, prosecutror.... - in the investigation or prosecution of criminals and you were a victim. If you apply and you are denied you may be placed in deportation proceedings.

For an incident that old, it will be tough to obtain the certification. You should look into other alternatives.

If your U visa gets denied and you are still in status, you will remain in the status you had before you filed your U visa. If you fail to maintain your legal status, USCIS may start deportation proceedings. Good luck.
