Will the state of florida extradite from new york on probation violation warrants, one for a minor felony, and one for a dui.

warrants were issued 9/1/09, i had to leave florida due to a domestic violence situation. I was unable to leave the home, had no key, was not allowed to have money. I have a 20 month old son and we have been in hiding for a year now. Should I get an attorney to get probation moved here, I do not want to be taken from my son, and have no issues transferring probation to this state and completeing it. I want this behind me and am desperate for any information that could help me in this situation
You should seek out representation to work out the situation. If not, there will be outstanding warrants which could lead to a request for extradition. It would be very uncomfortable living with those warrants hanging over your head. Good luck.
This question should be presented to a Florida attorney. Whether or not Florida will extradite will depend on what Florida wants to do but in the meantime you could be arrested anywhere at any time on the warrant (and held in jail for up to 90 days while Florida makes their decision). Generally it would normally be possible to have a probationary sentence transferred from one jurisdiction to another. In this case, however, because there is a warrant out things are much more difficult. If you have been found, after a hearing, to have violated probation you may get resentenced and no longer be on probation (you could technically go to jail). Discuss it with an attorney and s/he would be in the best position to advise and guide you.

Probation likely could have been transferred in 2009 but now you have been a fugitive for 2.5 years, have warrants for your arrest and likely VOP filed for your failure to complete probation. I think you should contact a Florida attorney to possibly arrange to have the warrants vacated and perhaps discuss a possible resolution to your Florida cases. If you voluntarily surrender yourself, they may go easier. Otherwise you risk that anytime the police find out about this you could be held in jail for a long time while Florida decides whether to extradict.

if there is a violation in NY, Florida will extradite. You should hire an attorney here to clear it up if possible or potentially face incarceration while the extradition process happens which can take weeks or months.
