I paid Mays rent and left may8th due too differences with my roommate. she said she was going too sell my stuff and so i went back too get my belongings and she locked me out of our apartment. the sheriff was called and i had less then 20 mins too get my stuff she now refuses too give my stuff back unless i pay June rent. but now agreed too giving my stuff back on the 30th. we are both on the lease and i don't think its right too pay June rent when i have no access too it! Will i get in trouble if i don't pay Junes rent?
Seek out an experienced landlord/tenant attorney.
In California, a tenant can not be forcible "locked out" by another tenant or the landlord where s/he is a genuine tenant. You have the equal right to occupy the premises with the roommate and she has no legal right to exclude you absent a court order.
Yes, you are obligated to pay rent to the landlord for June's rent.
However, you have a claim against your roommate who locked you out. Because you are a co-tenant, you have the equal right to occupy the premises with your roommate, who has no legal right to exclude you.
