I live in Georgia and i'm in the process of filing for legitimation, I am listed on my son's birth certificate but not my daughter's would that make it easier to file for my son since the mother lives in South Carolina.

You need to repost using a S. Carolina zip, so your post ends up seen by S. Carolina lawyers, not Georgia ones, since it sounds like you'll need to file there.

If the children you wish to legitimate live in South Carolina with their mother, then you need to speak with an attorney familiar with the law in that State. Best of luck to you.

The fact you are on the Birth Certificate here in GA. IS NOT DISPOSITIVE OF THE PATERNITY ISSUE. In other words being on the birth certificate can be rebutted by the mother through her pleadings. In short...get a lawyer, this is a very complex legal problem when you also consider two states laws [conflict of laws] presents a potential problem, this COUPLED WITH A NEED FOR D.N.A. AND THE PROCEDURE FOR GETTING IT IN EACH STATE etc. GOOD LUCK and GOD BLESS! Jerry
