Job location change - Is new H1B/LCA required before you start the job?

3 views 2 answers
Client job location changed to a diff county. My job duties remain the same and hence I am assuming there is no H1B amendment needed. My question below - 1. Since the new job location is in a different county should the new LCA be approved before the job start date? 2. Is there something like a receipt number for LCA (like H1B) based on which I can start work? 3. How long does it take for an LCA to be approved? 4. What is the USCIS fees for the new LCA?

The LCA is filed with the Dept. of Labor and there aren't any fees to file an LCA. You will need to file a new LCA and get a prevailing wage determination for the new area you will be working. The new LCA will need to be filed and kept in your public access file. If a mistake is made on the LCA or records aren't kept properly the employer could incur fines. It is strongly advisable for your employer to seek advice from an immigration attorney on how best to proceed in this situation.

At a bare minimum, an LCA is required. Your employer really needs to retain an experienced immigration lawyer to review all the facts, advise you, and handle the case.
