Hi. I was convicted of marijuana sales 2 years ago and still going to probation for it. Then I got into an argument with a stupid person on the road and they got me for exhibition of a deadly weapon (tire wrench) just for self protection a year ago. No physical contact and I finished my anger management already.
Then yesterday a cop pulled me over, searched my car, and found a 38-caliber bullet (1 bullet) that I honestly don't own. It belongs to my friend who is licensed to carry a gun. I got bailed out last night: it's so unfortunate because I recently finished school and I'm interning at a doctor’s office to turn my life around.
What’s going happen to me? Can my friend testify that the bullet was his and he accidentally left one (1) bullet in the car? Need help.
I would suggest that you and your friend make no statements of any kind until you talk to an attorney who can review your probation terms and get more details about when the bullet was left in your car, as well as the circumstances of how that happened.
The issue is not whether it was yours or someone else’s. The issue will be whether you owned, possessed, or have under your custody, something you were not supposed to because of a felony conviction. Depending on the circumstances, a statement by your friend could help the District Attorney, not you.
Talk to a criminal defense attorney in your area before resorting to things that may make things worse.
You need to stay quiet and get an attorney. It sounds to me like you have a solid defense that you did not knowingly possess the ammo. Your attorney will best be able to determine how to approach this. Go meet with a few attorneys and choose the one you like best. Most give free consultations. Again, you should not speak with ANYONE other than an attorney about this matter, especially law enforcement.
If you cannot afford a private attorney the court will appoint you a public defender, just request one at your first court date.
First, if you are in West Covina, you are definitely going to need an attorney on your case. The District Attorney in West Covina is going to give you the worst offer at EDP (Early Disposition Proceeding).
If you had no knowledge of this being in your possession, you do have a good defense, but that won't make a difference to the DA in West Covina who makes the EDP offers.
