Ex husband won't sign for sons passport

How can I get my son a passport if his father refuses to sign? I am remarried to a man that is in the military and he has been supporting myself and my son for the past 5 years. We plan to go on vacation over seas but my ex husband wont sign for a passport. I am also worried that he might try to take custody. I have sole custody from the day we divorced and my son has been with me 99% of the time. I have heard horror stories about spouses of military members losing custody because they married someone in the military. What are teh chances of this happening if I were to take this matter to court? His father does not work, lives with his ex girl friend in a shack made out of a horses shed, and owes over 11,300 dollars in child support that he refuses to pay. He quits his jobs when he finds out they are garnishing his wages for child support (he's only ever had 2 jobs in the past 7 years)

I would recommend you start by reading your divorce decree. It should contain a provision dealing with international travel. Often, these provisions discuss obtaining a passport for your child. If your ex is violating the court order you will need to enforce those rights in court. A motion to enforce may be in order. If your decree does not mention international travel then you may need to file a motion to modify and ask the court to address the issue. Either way, you will need an attorney to assist. I'd recommend scheduling consultations with local family attorneys. Bring your decree with you and ask what your options are. Let them know your concerns about child support, the military, and international travel.
