Your situation is not entirely clear. Why would your daughter have any claim on your mother's property in the first place? Regardless, you are free to leave your estate in any way you choose. If you do not set things up properly, (by hiring a qualified estate planning attorney to set things up, in order to protect both you and your son), then your daughter could contest your estate plan, and depending on the circumstances, maybe she could win. If you DO set up your estate plan correctly, through a qualified attorney, your daughter could probably STILL contest your estate plan. But she would then need to overcome the testimony of your attorney, plus the fact that you intentionally set things up to exclude her. Her chances would be very slim, and virtually non-existent. This is not something that should be overly expensive to set up, in my opinion, although a simple Will is probably not the planning tool I would select. Meet with a qualified estate planning lawyer and make sure this gets done right! James Frederick

Mr. Frederick offers sound advice. Get with a qualified estate attorney to discuss your goals and have the proper documents drafted. Be aware however there is more to estate planning than just drafting a will. You are not required to leave her anything. However, she may choose to challenge your estate plan if it is not done properly. So the key is to consult with a professional to make sure your plan is properly done.
