Mr Fromm is right you need to consider hiring a lawyer fast to sue your brother for an accounting and possibly also in respect of your mother, for tortious interference with an expectancy, if that is a viable cause of action in your location. Also, in theory when your father dies, you might be able to open an estate to collect the loan from your brother as well, even if you think there may be no other assets. That is all what your lawyer in your location will have to help plan out based on the facts, laws of the jurisdiction, and contingencies.

You need to speak with an estates litigation attorney or a litigation attorney to seek an immediate accounting of his actions, a surcharge or civil action for recovery of the stolen ("borrowed") monies. Get with an attorney today. The longer you wait the less chance of recovery. Hope this helps. Please remember to designate a best answer to your question.
