How do we know if the respondent for divorce has responded so that I can go on with a default case.

The case was filed and given to the Sheriff department to serve. I have received the proof of service but don't know if they have responded or will not be responding. What should I do to find out?

You can check the court file to get that information. Often you ca call your local clerk's office at the local courthouse. If you are lucky the information will be available online as it is in some jurisdictions. If you hire an attorney she or he will take care of all of that for you.

If a Response was filed, it should have been served on you, along with a Proof of Service of the Response. The Clerk won't accept a Response without a Proof of Service of the Response. Check the Court's Website case history on your case; or go to the Clerk's office and ask to see the case file - and if there is a Response in the file, purchase a copy of the Response and any other documents filed by the Respondent. If over 35 days have passed since the Respondent was served, you should file a Request to Enter Default. You would best retain an experienced Family Law Attorney to represent you. If you can't afford to hire an attorney, contact the Superior Court's self-help center and make an appointment to get guidance from a volunteer attorney.
