Possbily and that the best answer you can get online. You really need to retain local counsel so they can advise you regarding how defendable the case is. Inaccuracies in police reports are good ways to chip at the Commonwealth's case. You can only determine if it is a viable part of your defense once you have had counsel evaluate all aspects of the case.

Two things you must do: 1. Do not place any details of the pending criminal case online for any reason (that is never wise and possibly may lead to civil liability), 2. Do not discuss the pending criminal case with anyone but your criminal defense attorney for possible strategic ways to address any case flaws, omissions and mistakes.

This may be used to cross-examine the officer regarding his recollection or perception of the events. However, it appears as if you have acknowledged that you sideswiped a car online. This may cause problems with potential suppression issues. You, and other posters, should be careful what you put online. It can be used against you. Michael L. Doyle (215) 900-5565

If the Officer has incorrect info it reflects on his credibility, so it is possible it could be used. Hire a local attorney to assist.
