647(b) removal from record
Anonymous3 views3 answers
I got 647(b) in California. It is first time. Court gave me some fine(around $400) & 2 years probation. It is almost one year now.
I apply for a job and they refuse after making offer when they do my background check only because of this. Someone told me that I can remove this from my record after finishing probation time.
I need to know is there any way I can remove this from my record earlier? Or I have to wait to finish 2 years of probation
because you are having trouble getting a job, you may be able to end probation early and have the charged dismissed (commonly known as an expungment). Although it won't seal your record, it helps when applying to private firms because it shows the charge as dismissed.

Yes, it's possible to file a petition to terminate probation and to simultaneously request an "expungement." I file those routinely after the first year of probation, however granting or denying the request is discretionary with the particular judge involved.
You would need to get in front of a judge, which means that you'll need to file a motion for early termination of probation with the court. There has to a be a good reason for a judge to grant an early termination of probation. If you are truly having a hard time finding a job, you'll need to back that up. I suggest you hire an attorney for this process as well as the expungement process. Good luck.
