Hello, I have 2 questions, 1) I made a mistake in filing the I-485 because I'm living in Japan. I wrote a letter says I am withdrawing the I-485 and I want the I-130 to be processed as a Consular Processing case. But I didn't give them the I-130 receipt number,I attached a copy of I-485 and gave them the I-485 receipt number ,USCIS Alien Number and Priority Date.Should I write them a letter again or it's ok? 2) My husband filed the I-130 in Feb. and we received from USCIS in May says I-130 transferred to NBC, what does this mean? Thank you so much!

You may write a letter again, however, since your I-485 is linked to your I-130, immigration should inform you that they cannot process your I-485 since you are outside the country. Transferred to NBC, means that it was sent to National Benefits Center. Once your I-130 is approved, it is sent to NBC for further processing, either adjustment of status or consular processing. In your case, it is consular processing.

You may write the letter again. Transfer to the NBC or MSC may be correct then again may not be. This is the exact reason why this is not for the do it yourself crowd.. You probably need a lawyer to fix this.

1. You can try writing a new letter. 2. All it means is that it was transferred. You should retain an experienced immigration lawyer, whether myself or one of my colleagues, to review all the facts, advise you, and handle the case.
