Recently divorced and ex-spouse starts work. She is asking for 1/2 of the day care and it is not part of the divorce settlement. What am I reponsible for?

Mr. Gornbein is correct. As a general rule, the percentage for child care will be the same as your child support percentage. So, if what you pay in child support is 65% of the total child support under the guideline, you will likely pay around 65% of the child care cost. The lawyer who handled your divorce should be able to give you a more precise idea of what you will pay.

Hi, Normally day care is factored in as part of child support. If it was not in your case then it is based upon a percentage of your incomes and your former wife's. There are actual guidelines in the child support formula to cover this issue. Talk to an attorney in your area for more advice and information. Good luck to you. Henry Gornbein
