Shoplifted at Sears, what happens now? Should I pay civil demand?

Shoplifting 3 views 4 answers
I got caught outside of the store by LP. I'm 18 and this was my first time. They took me to the back and took my information, driver's license, and address. No police involvement. I took 3 shirts which were all undamaged with tags on, they took pictures of it and the total was $75. They made me sign two papers, I don't really remember what it was for but i think it was to admit that I took the stuff. They said that I would get a Civil Demand letter in the mail, and let me go. Should I pay the fine when i receive it? Will this be on my record? Will employers know about this when I apply somewhere? Thanks in advance.

A civil demand letter does not create an independent obligation to pay, unless it is followed by a civil lawsuit resulting in a judgment against you. Were you to get something from the police or courts you must pay attention to that communication, but a private letter from a company or law firm is not the same thing.

I generally advise clients to ignore these civil demand letters. You don't owe them anything. In order for you to owe them something they would have to sue you, (in some jurisdictions prove damages which they most likely couldn't do), and win. Even if they could win, the cost of pursuing this is substantially greater than any amount they can possibly recover so they usually don't. They send out these letters because it doesn't cost much and they are hoping that you don't know better and simply send them the money. Nothing will happen to you if you don't pay it.

By and large most major cities they will not if called by the proprietor they will not show up and make a report or arrest anyone for minor shoplifting. If there is no police report or charges this will not show up on your record. In my past experience when my clients received the shake down letter from the shop owner we have successfully ignored their request. The last time this occurred was in Newpark Mal and l sent them a pound sand letter and they went away.
