Pending shoplifting and receiving case. When applying for jobs what do I say?

Usually they always ask on an application if you've even been convicted of a crime? My official court date is a few weeks away and they haven't technically said I was guilty or anything so what do I say when I'm filling out a job application? Do most employers usually check your criminal record?

If you have not been found guilty after a trial, nor plead guilty in front of a judge, you have not been convicted of a crime. However, the CORI will show open cases. Your case is still open because it is pending. I am under the impression that most employers do check your criminal record.

Usually honesty is the best policy. If you are asked whether you have been convicted you can answer honestly "no" however I might clarify that answer by stating there is currently a case pending. For certain types of jobs potential employers generally do run a background check on potential employees, specifically for jobs dealing with children, the elderly, sick etc.

You have not been convicted of a crime until a guilty plea is entered or a guilty verdict is rendered. Many jobs ask whether you have been convicted of a felony - if your cases are misdemeanor level offenses, you can honestly answer "no" to that question even after a conviction. Read the applications carefully and answer honestly.
