If an arrest warrant is issued for a non-US citizen for FTA who is re-entering the country, will they be detained upon reentry?

In December 2011, my partner was arrested by LA Sheriff's Dept for a battery misdemeanor (242 PC). He was released from jail that same night, but in February 2012, he did not attend his scheduled court appearance. I'm fairly certain there is a warrant for his arrest because of it, but I haven't been able to confirm this. He is now back in his home country, but would like to return to the US soon. We want to settle this matter so that we can continue to see one another in the US, but we want to be fully prepared. If he attempts to re-enter the country, will he be immediately arrested and detained in the airport? Will he be allowed to re-enter? Or will he be sent home?

Since you don't know if the warrant exists no one can give you a definitive answer. However in checking passenger manifests the TSA uses the NCIC information system. That system does not pick up ordinary misdemeanor warrants but will pick up serious misdemeanor warrants (which we don't have in CA). If for any reason he is in the system, he will not likely be allowed to board a plane for the US in whatever country he is coming from. Since an attorney can appear for him on a misdemeanor it would be best to hire one to clear up this mess before your friend attempts to return.

Mr. Kaman is correct. An attorney can appear for your partner and start the process if clearing his warrant up. Andrew Roberts (818) 597-0633

Yes, however most likely for a misdemeanor depending upon the circumstances of the case, it may not occur. It is however easy to remove the warrant prior to him entering the country. Feel free to give us a call to discuss the case. Lawrence Wolf www.youareinnocent.com

This is somewhat of a common issue and it's easy to fix. An attorney can go to court and recall the warrant and we do this in our offices routinely. Let us know if we can be of assistance.
