less than 2oz and my first drug offense, im fighting my case because the officer didnt ask me to search my purse, they set a court date for tomorrow ... i dont know what to expect i have never been in trouble like that... am i going to get drug tested right there in court tomorrow ? and if i fail they use it against to put me on probation or they use it against me and they put me to jail.? please help ... thanks
Make sure you have a lawyer to represent you when you go to court tomorrow. You need to either hire one today or if you can't afford one, the first thing you should do tomorrow is to ask for a court appointed lawyer. Don't do anything in court without a lawyer. It is unlikely they are going to drug test you tomorrow without you pleading guilty. Off the top of my head the only scenario I could see a judge making you take a drug test without you already being on probation is if the judge makes it a condition of your pre-trial release.
Botton line, get a lawyer, especially if you want to challenge the search with a motion to suppress.
