3rd Dui in San Diego
Anonymous2 views3 answers
I received my third dui within three years in San Diego. No Accident BAC of 0.20. Since then I have completed a 30 day residential alcohol treatment and been attending AA meetings. What type of alternative sentencing options and length are available.
A third time DUI carries a minimum of 120 days of jail up to one year in jail if convicted. There are possible alternatives to the jail time such as work furlough, residential rehab, electronic confinement (house arrest), but whether these options are available to you will depend on many factors including the Judge your case is in front of, your prior criminal history, whether you are working, etc. You should speak to local experienced criminal attorneys regarding the specifics of your situation. Many criminal attorneys such as myself offer free consultations.
The law requires a judge impose a minimum of 120 days custody. However, that custody may be served in residential rehab, work furlough, or by electronic monitoring. A host of factors affect where custody is served. It will be the job of your attorney to persuade the court that an alternative to jail is in everyone's best interest. Please feel free to contact my office for a free consultation to address any additional questions or concerns.

Work furlough is probably your best bet, although a lengthy stay in residential rehab might be best on multiple fronts.
Each case is different and the facts surrounding you, your current case, your priors, and even what courthouse your case is in will all determine how much time you get and where you get to serve it if convicted.
Contact locally experienced criminal defense attorneys and hire the best one you can afford.
