Respected Sir/Madam, I Graduated in May2010 and right now on my extended OPT Status in my F1 VISA which is expiring on 26th december2012. I'm working for a reputed US Commercial bank for the past 15months on my OPT. Unfortunately my employer has missed to apply my H1B and the quota is already over by june11th 2012. I guess i have to wait till april2013 for the quota to open and apply for my H1, but after dec26th 2012 i will be out of status .Kindly let me know what are the options or ways availale for me to continue my stay legally in US. and to continue my work at the client 's place. Many thanks and regards in advance.

I agree with my colleague. You might be able to change your status to L.

Unless you have a STEM degree and your employer qualifies for a STEM extension, the facts you give reveal only two options: 1) Continue studying, or 2) leave the US. You should retain an experienced immigration lawyer, whether myself or one of my colleagues, to review all the facts, advise you, and handle the case.
