Can you get a reckless driving conviction removed from your record?

I received a reckless driving charge in February 2008. I have applied to the fire department and EMS in my hometown of VA Beach, however, I have been denied due to this conviction. Is there anything I can do to get this off my record or reduce to a speed ticket?

The simple answer is no, if you have been charged and convicted with an offense in Virginia you cannot have it expunged. There is a slight chance that the mistake may have been made and you could get it overturned on a technicality. However, I would not hold my breath.

I agree with the other lawyer that if you were convicted, then expugement is not an option. In most cases though, an employer such as the fire department or EMS will only consider convictions that are relatively recent -- for example within three years. So, even if expungment is not an option for you, my suggestion is that you check with the potential employers (and maybe in surrounding jurisdictions) and see what their qualifications are for the position. It may be possible to reapply after the time has passed and the old conviction would no longer be weighed with the application.
