Does a landlord need to disclose asbestos to a tenant?

Business 2 views 3 answers
In a California apartment, does the landlord have an obligation to disclose the presence of asbestos to a tenant or a prospective tenant? What if the landlord is a state agency (specifically, an apartment owned by a public university)? Are there any other obligations relating to asbestos that a government landlord has (e.g. removal)? Thank you very much.

While I cannot give you legal advice in this forum, there is a disclosure obligation but with exceptions and restrictions. There are many internet forums that discuss this issue, and reference the code sections.

Although it might be prudent for a landlord with knowledge of the presence of asbestos to disclose it to tenants or potential tenants, California law does not mandate that a landlord provide such disclosures when renting out property. Nor does California law require removal of asbestos. Residential property built before 1981 often contain asbestos, but typically does not present a health problem unless there is subsequent construction which messes with it.
