Is there a way to get the DA to drop battery charges?

My husband was charged with battery for threatening me in a arguement, he never laid a hand on me, but my step son told the cops that he grabbed me, I didn't want the charges but I was told I had no choice, I want him home.

As to whether or not the D.A. Files is entirely up to them. Even if everyone recants their story, they can still choose to file against your husband. I would suggest you go to his original hearing and try to speak with anyone who will listen. You should consider hiring a criminal attorney immediately if the D.A. Moves forward. Good luck!

I agree. The DA decides which cases to prosecute. I would suggest hiring a lawyer to represent you or to advise you as to how to proceed. The DA negotiates for the State of California, not private citizens.

The DA decides whether a case goes forward or not. He needs to hire a good criminal lawyer who can advocate for him with the DA.
