Motion to Reconsider/Reopen and Appeal

Hi, my H1B got rejected June 28. my employer might think about filing to either a Motion to Reconsider/Reopen or an Appeal. Q1. But on the rejection letter, it didn't mention MTR. It only mentioned Appeal. Does that mean I'm not eligible for an Motion to Reconsider/Reopen? Q2. I heard that MTR usually takes a shorter period time for processing than appeal, is that correct? How long would that be then? Q3. Does MTR accept additional evidence or it really differs depending on the case? Q4. If MTR and Appeal are eligible for most cases, how to pick which approach to go? Please help. Thanks.

I will answer Q4, last part, only .... how to decide. Sit sown with an attorney ... he/she needs to look at all the paperwork to make the professional decision of the best way to proceed. This is too complicated for an blog.

You may be able to do a motion to reopen, depending on the basis for the denial, and why you believe the denial is incorrect. A motion to reopen often does take shorter time to process. A motion to reopen generally does involving submitting additional evidence. Which one you choose depends on why you believe the decision is incorrect and how you intend to demonstrate that.
