I have done my bachelors in computer science and working for company A from 6 years. And I have applied for H1B this year from company B and my application is in process and I got my EAC number. Now my Company A(presently working) was willing to file my L1B. Can they file for L1b when my H1 is in process or Do I need to wait till I get reponse on H1B.
An L-1B can be filed from a different company while an H-1B petition is pending. However a foreign national cannot have more than one status at the same time, so you should consult with an immigration lawyer regarding the timing issues involved in having both applications pending at the same time or you might end up in a different status for a different employer than you originally intended.
