Should I consider a medical malpractice lawsuit against a doctor?
Anonymous3 views3 answers
In Sept of 2010 I had to under-go a range of tests to see if I had been struck by a stroke, this included MRI's and an MRA. Both required contrast dye injection in order to make my blood vessels stand out. I had the MRI first and when they gave me the contrast dye the tech also gave me 2 saline injections to delute the dye so it isn't as hard on the body. Within 10 days referred to a Neurologist who ordered and MRA w/ dye after badgering me in my appt (I nearly walked out after was told 5 times to stop smoking when I told the Dr I did not smoke among other verbal attacks). W/ the MRA they did not dilute and went into kidney failure within 36hrs of the MRA. Having problems still with Kidneys, is it worth to look into a malpractice suit because of the neglegence of the office and its workers

Contrast dye used for radiological procedures causes serious reactions in a small number of people. The injury itself does not prove that there was malpractice. Sorting out the results of malpractice from the unavoidable risk of a procedure can be difficult. You should consult with a medical malpractice lawyer sooner than later. Such consultations are generally free. Do so soon- I do not know what the statute of limitations is in your state, but you are coming up on two years which is the statute of limitations for malpractice in many states.
Mr. Brody is spot-on in his advice. These are difficult cases but you cannot know until you get and review the records. Also, it appears that the statute of limitations in Wyoming for medical malpractice is 2 years. However, all states have specific rules about when the statute of limitations begins to run. You should consult with a local malpractice attorney to get the specifics.
These can be difficult cases because a bad reaction does not necessarily equate to malpractice. A local malpractice lawyer needs to review your medical records and perform an investigation. You should contact a local lawyer asap because these cases must be brought within a specific amount of time and it can take time to receive and review all the records.
