Will I be extradited to Florida if picked up in NY?
Anonymous3 views2 answers
I left Florida in May 2009 to move to NY. Once I was in NY, I found out that I had a warrant in the State of Florida for Felony Forgery (checks). I moved to NY before the warrant was issued and have never been served with papers. If I get pulled over in NY and picked up on this warrant, will Florida extradite me for the $1100.00 in forged checks?

If you are charged with a felony in Florida, that information will be transmitted nationwide. When you are pulled over you will be arrested and held on a fugitive warrant. The State of Florida might decide not to come to get you, but you could be held in jail while they decide --which could be a matter of weeks. You might be able to have your counsel in New York get bail set for you here, but that is not certain. The best thing to do would be to retain counsel in Florida and straighten the case out there. Otherwise, a moving violation could end up turning into a nightmare.
I concur with my colleague's answer. In most cases Florida will "get around" to coming up and getting you once you are detained. And while it may be for a minor matter in NewYork, you will be held without bond until Florida arrives (or a NY court takes action). My best advice is for you to make contact with a florida lawyer in that area, conduct some investigation into the case, prepare to make restitution, and set a date to voluntarily surrender to this Florida court. You may be surprised to find that if restitution is paid ahead of time, the prosecution of your case may move far smoother.
