Is it possible to have two H1B employers for a 1 month overlap time?

I am transferring with my H1B from university A to B. University B pays for moving expenses by giving me one extra month of salary - basically start the contract 1 month early and I would have a 1 month overlap with double payment. Is that possible or does that jeopardize my visa status?

If you work for the second employer before the correct starting date, it is a problem. If they pay you moving expenses before the starting date it is not very likely at all to be a problem.

You can start working for employer B as soon as USCIS receives the I-129 petition. This is part of the portability provisions for H-1B under AC21. You should meet with an experienced U.S. business immigration attorney so they can review the documents including the employment contract.

Yes, it is possible. Your employer needs to retain an experienced immigration lawyer, whether myself or one of my colleagues, to review all the facts, advise them, and handle the case.

If it is moving expenses, and not pay, it will be OK. Talk to your lawyer ... not the HR department. Capriotti International Law www.capriotti.com [email protected] 1-503-803-0055 SKYPE 3-WAY VIDEO AVAILABLE
