My husbands Workers comp check is late by 18 days.....

My husbands case is getting close to being settled. But in the mean time his claim adjuster has sent no information to his lawyer (which we can never reach, thinking about getting a new one.) and she has said that she sent it out once before and he never got it nor have we received his IME reports like she states was mailed out. And when he talked to her last week she said she was now waiting on it to be approved to be released. So she was caught in a lie. And now she said she mailed out his monthly check two weeks ago to our new address and yet we have not received it!!!! UUUUGGGGH these people are crooks. I really would just love to make them pay!

It does sound unfortunate so close to settlement. You should probably discuss the problem with your attorney.

I have practiced WC law in Virginia for 35 years. Late weekly checks are a constant problem. Check to make sure the check was mailed to the right address especially since you changed addresses. Also, check your old address and make sure your mail has been forwarded to you. In my state if a check is 14 days late there is a 20% penalty. Check in your state for a similar penalty statute.
